Well now, The Feds are going to sue Arizona. But instead of Constitutional grounds, it appears the Justice Department will sue on the assumption that the Arizona law intrudes on Federal Immigration Authority.
Lets first look at:
Article. I, Sec. 8, clause 4.
“The Congress shall have Power … To establish an uniform Rule of Naturalization.”
So, on this subject of Illegals, the strength and limits to the Federal government is stated above. No more, no less.
Now, lets look at the 10th Amendment:
The 10th Amendment
The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.
Since Immigration is NOT delegated to the Federal government, and not prohibited to the States, are reserved to the States, or to the people.
However, The Supreme Court has in the past ruled that the Federal government does have the right to legislate immigration. Ironically, the Supreme Court has only upheld this in certain individual cases involving individuals. This will be the first IMMIGRATION suit against a state. If this suit does come about and the decision goes against Arizona, it will ultimately appear before the Supreme Court. Arizona will see to it.
And this brings us to Hillary, and her comment in Equador on June 8, which sparked all this off. With her considerable experience, and considering her failure of normal protocol, is there anyone here that feels she made a “Mistake”? I certainly don’t think this was a mistake.
I think she very carefully weighed what she wanted to say, conferred with Bill, and then said it. Of course, there is the usual flap, hue and cry of foul, lack of protocol etc. Governor Brewer has expressed her outrage in no uncertain terms. Instead of expecting the Obama staff visiting Arizona to tell her, and the state, what help she could expect, the state of Arizona, in general, and Governor Brewer in particular have both been stabbed in the back by the Obama administration. Pretty cool huh?
But all that is already being forgotten because of the threat and increased publicity that the Administration is going to sue Arizona. Hillary’s comments/disclosure is already being forgotten.
Of course, she will most likely be called home to get a dressing down by Barry. She will get mad and resign, which will be what she wanted all along. Now she is free to even further undermine BO in gearing up for her campaign in 2012. Unless the GOP comes up with the right candidate, she will be difficult to beat.
Hillary’s timing was impeccable. In a brief few seconds, she has forced Obama and the Justice department into knee jerk reactions that they are certainly not guaranteed to win. And in losing, if they do decide to sue gives further proof of an incompetent federal government.
I take my hat off to Hillary. Brilliant timing.
